カリフォルニア州議会元老院（英語:The California State Senate）は、アメリカ合衆国カリフォルニア州の州議会であるカリフォルニア州議会の上院であり、下院はカリフォルニア州議会代議院である。州上院は州下院とともに、州都サクラメントのカリフォルニア州会議事堂で招集される。

州の人口が多いことと、1879年の憲法批准以来、議会の規模が拡大されていないことが重なり、州上院は州議会のどの院よりも議員一人あたりの人口が多い[1]。アメリカ合衆国下院では、カリフォルニア州は52人の連邦下院議員を擁し、1人あたり約75万564人の有権者を代表しているが[2]、州上院では、40人の州上院議員が1人あたり約93万1349人の有権者を代表している。つまり、カリフォルニア州の上院議員は下院議員よりも、また全米5州よりも多い人数を代表していることになる。

現在の議会では、民主党は40議席中32議席を占めており、議席の80%を占めている。これは、3分の2である27議席をはるかに上回る。

歴史

1849年の州憲法では、「上院議員の数は、下院議員の3分の1以上、半数以下とする」と規定されていた[3]。また、1849年の憲法では、上院議員の任期は2年とし、2年ごとに改選すること、上院議員の総数を2つのクラスに分け、毎年半数ずつ改選することと規定されていた[4]。

1879年の州憲法の批准を受けて、州憲法では上院議員40名で構成される上院議員は、全員がカリフォルニア州内に3年間、選挙区内に1年間居住していなければならないと規定された[5]。選挙区は「可能な限り人口が均等であり、隣接する地域で構成される」ものとされた。各上院議員に1つの選挙区が割り当てられた。また、選挙区は政治的な境界線を維持することが以下のように義務付けられていた。「このような選挙区の編成にあたっては、その中に2つ以上の選挙区を形成するのに十分な人口が存在しない限り、郡または郡と市を分割してはならない。また、いかなる郡または郡と市のいかなる一部も、いかなる選挙区の形成においても、他の郡または郡と市と統合されてはならない。[6]」

1933年から1967年にかけて、州議会の選挙区は「リトル・フェデラル・モデル」に基づいて設定されていた[7]。このモデルでは、下院議席は人口に応じて、上院議席は郡の境界線に応じて割り当てられていた。ガイドラインでは、上院選挙区は3つ以上の郡を含んではならず、また1つの郡も含んではならないとされていた。

その結果、ロサンゼルス郡（1960年の人口は600万人）のような人口の多い郡と、アルパイン郡（1960年の人口は397人）のような人口の少ない郡に、同じ数の州上院議員（1人）が割り当てられるという状況が生まれた。上院選挙区は、人口分布の変化にかかわらず、1933年から1967年まで変更されなかった。合衆国最高裁判所は、レイノルズ対シムズ事件において、すべての州に人口が均等に配分された選挙区を定めるよう命じた。そのため、判決に従うために境界線が変更された。

役職

副知事は上院の職権上の議長であり、可否同数の場合にのみ投票権を有する。仮議長は多数党院内会派により選出された後、上院全体での承認を受ける。その他のリーダー、例えば多数党院内総務および少数党院内総務は、議会の各党の勢力に応じてそれぞれの党院内会派により選出される。

任期

各州の上院議員は、デラウェア州とほぼ同等の人口を代表する。1990年の提案140号と2012年の提案28号の結果、2012年より前に選出された議員は任期制限により4年任期を2期（8年）まで務めることができるが、2012年以降に選出された議員は、4年任期の州上院と2年任期の州下院を組み合わせて、最長12年間議員を務めることができる[8]。

州上院議員は4年の任期を務める。2年ごとに、40議席のうち半数が改選となる。これは、80議席すべてが2年ごとに改選となる州下院とは対照的である。

議事堂

州上院議場の赤を基調とした内装は、同様の色調でまとめられた英国の上院議場をモデルとしている。演壇は「E」字型の壁に沿って設置されており、中央の突出部には演壇が設けられている。下段の演壇は議場全体にわたって設置されており、上院役員が使用する椅子やコンピューターがいくつか置かれている。

最も目立つ席は、出席確認を行う書記官のために確保されている。上段はより小さく、3つの椅子がある。最も大きく装飾的な2つの椅子は、仮議長（右側の椅子）と副知事（左側の椅子）が使用する。中央にある3つ目の最も小さな椅子は、議長代行（仮議長の代理を務める）が使用するが、議長が起立することが期待されているため、ほとんど使用されることはない。

上院に出席する最高位の非議員高官、例えば外国の要人や政府高官などが使用する演壇の両脇には、他に4つの椅子が置かれている。40人の上院議員にはそれぞれ机、マイク、2脚の椅子が用意されており、1脚は議員用、もう1脚はゲストや立法補佐官用となっている。装飾のほとんどは下院会議場と同じである。欄干に沿ってジョージ・ワシントンの肖像画と、「senatoris est civitatis libertatem tueri（上院議員の義務は、連邦の市民的自由を守ることにある）」というラテン語の引用文が掲げられている。
